AGREEMENT TERMS AND CONDITIONS

1. Q-Park AB's obligations

1.1 Q-Park AB, hereinafter referred to as "Q-Park", provides parking spaces for payment. Q-Park instructs the customer where vehicles must be parked and provides parking permits or passes in certain cases. Q-Park reserves the right to direct the customer to another parking space in the event of renovation works, traffic diversions or similar. Q-Park is not responsible for damage or break-ins to vehicles in parking spaces provided by Q-Park.

2. The Customer's obligations

2.1 The customer agrees to park in accordance with Q-Park's rules and signage in parking facilities (as specified on the front page of the invoice). The customer must only use the parking space to park a private car, unless otherwise agreed in writing. The customer must ensure that, where appropriate, gates and doors are closed and locked after use. The customer is not entitled to allow unauthorised persons to enter locked parking facilities unless otherwise agreed in writing.
2.2 The customer undertakes to comply with the regulations applying to the parking facility at any given time. The customer is not entitled to wash or repair cars in the parking facility. Customers that have access to a parking space with an engine heater in accordance with an agreement in writing are not entitled to use the engine heater for any purpose other than temporary heating of the vehicle. The customer is responsible for cleaning, snow removal and sanding the parking space.

3. Parking permits and passes

3.1 The following applies to customers who receive a parking permit or a pass: A parking permit is a valuable document that is valid provided that payment has been made for the period. The customer agrees to place a valid parking permit in a clearly visible position on the left-hand side of the windscreen of the vehicle when parking. A control fee may be issued if there is no valid parking permit in the vehicle when parking or if the permit is not positioned as described. Q-Park does not replace lost parking permits. Passes are used on entry to or exit from a parking facility. The customer is responsible for immediately reporting the loss of a pass to Q-Park's customer services. The customer is responsible for any costs that may arise as a result of careless use of a pass. Q-Park is entitled to charge a deposit for passes.
3.2 If the agreement ceases due to termination or for any other reason, the customer is responsible for returning any passes when the agreement ceases. Passes must be returned by registered mail or in the attached reply envelope. If Q-Park has not received the pass one (1) week after the expiry of the agreement, Q-Park is entitled to charge the customer for any costs relating thereto.

4. Agreement period and termination, amendment of the terms and conditions

4.1 This agreement applies for the period agreed by the parties when entering into the agreement (as specified on the front page of the invoice). The agreement must be terminated in writing, by e-mail or using the form at www.q-park.se at least one (1) calendar month before the end of the current agreement term, unless otherwise agreed in writing, otherwise the agreement will be extended by same period each time. The customer number must always be specified when terminating the agreement.

5. Payment

5.1 The fee, plus the value added tax applicable at any given time, must be paid against an invoice or by direct debit no later than the due date. In the event of late payment, the customer must pay interest under the Interest Act (1975:635) and compensation for written payment reminders in accordance with the Act (1981:739) on compensation for debt recovery costs, etc. Compensation for payment reminders is payable at the amount applying at any given time in accordance with the Ordinance (1981:1057) on compensation for debt recovery costs. The customer is obliged to pay the full fee for each agreement period begun. Q-Park is entitled to change the fees for a new agreement period. Changes in fees must be notified at least one month in advance.
5.2 Q-Park reserves the right to charge an invoicing fee. In the event of late payment or non-payment, interest on overdue payment is payable in accordance with the Interest Act.

6. Personal Data

6.1 Q-Park intends to process customers' data such as names, personal identity numbers, addresses and telephone numbers, etc. in order to meet obligations under this agreement such as the provision of services, administration, customer services and invoicing and also for marketing purposes, which means, among other things, that information and offers will be sent automatically to the customer. By entering into an agreement on parking with Q-Park, the customer gives his or her consent for Q-Park to process personal data as described above.
6.2 The customer is entitled to ask for inaccurate data relating to him or her to be corrected. The customer is also entitled to receive information on customer data once a year free of charge. Requests for correction or information must be submitted in writing to Q-Park's customer services.

7. Assignment

7.1 The agreement may not be assigned without consent from Q-Park in writing. No assignment will be approved until the outgoing customer has settled all his or her debts with Q-Park.
7.2 The customer is not entitled to make a parking space available to another person unless otherwise agreed in writing.

8. Breach of contract, etc.

8.1 Q-Park is entitled to terminate the agreement in writing with immediate effect in the event of delay in payment or if the customer is in breach of the terms of this agreement in any way. Q-Park is also entitled to terminate the agreement in writing with immediate effect if the customer suspends payments, enters into negotiations on a composition with its creditors, goes into liquidation, is declared bankrupt or shows other clear signs of insolvency.

9. Disputes

9.1 Any dispute arising out of this agreement must be settled by a Swedish court in accordance with Swedish law.

10. Force majeure

10.1 Q-Park is released from the obligation to fulfil its part of the agreement and from the obligation to pay compensation for damages if its obligations cannot be fulfilled at all or can only be fulfilled at an abnormally high cost due to laws enacted in Sweden or abroad, measures by a Swedish or foreign authority (such as fuel restrictions), war, terrorist attack, fire, explosion, strike, traffic diversions, blockade, boycott and lockout or other similar circumstance. The disclaimer applying to strikes, blockades, boycotts and lockouts applies even if Q-Park is itself subject to or adopts any such conflict measure.


1. ONLINE PURCHASES


1.1. For online purchases at www.q-park.se, an agreement is made between the customer and Q-Park AB, org. reg. no. 556553-5548, Box 90 240, 120 23 Stockholm, hereinafter referred to as "Q-Park".
1.2 The following terms and conditions apply, mutatis mutandis, in conjunction with sections 1–10 on p. 1.
1.3. When an agreement is made in accordance with sections 2 and 3, Q-Park makes a parking space available to the customer at the time and in the parking facility chosen by the customer. Parking takes place in the parking facility chosen by the customer from the chosen starting time. The parking space is unreserved. Q-Park reserves the right to direct the customer to another parking facility.

2. ONE SHOT PURCHASES AND SUBSCRIPTIONS

2.1. Q-Park provides the customer with a parking space to park a private car against payment by means of a one shot purchase or a subscription. The range of available parking spaces is set out on the website at www.q-park.se.
2.2. When payment has been made, confirmation of the right to use a parking space is sent to the e-mail address specified by the customer/the customer's account. Q-Park saves this information. The customer is prompted to either print out the confirmation him or herself or save the confirmation sent by e-mail.
2.3. The right to use a parking space takes effect when the customer approves the charge, the general terms and conditions and the storage of personal data and when the payment has been received by Q-Park. A final agreement between the parties has been entered into when Q-Park has sent confirmation to the e-mail address specified by the customer/the customer's account.
The customer is responsible for reading the information on how to find the parking facility presented by Q-Park in the booking dialogue and confirmation. The agreed price applies to the parking space paid for in the chosen parking facility.
2.4. A control fee may be issued if a parking permit is required and there is no such permit in the vehicle when parking or the permit is not positioned as described. This also applies if the period paid for is exceeded.

3. PAYMENT

ONE SHOT PURCHASE
3.1. A parking fee is paid for one shot purchase. The amount of the fee depends on which parking facility has been chosen and the period for which the parking space has been booked.
3.2. The parking fee must be paid by the customer at the time of the booking in accordance with section 2.2.
3.3. The right to use a parking space becomes invalid if the card company denies the card transaction.
3.4. If the vehicle is collected before the end of the period booked, no refund will be payable for the unused time.
3.5. In the case of a one shot purchase, the customer can cancel the booking at any time up to 24 hours before the beginning of the agreed booking period. The cancellation is free of charge and is carried out via the website www.q-park.se. If a cancellation occurs less than 24 hours before the beginning of the booking period, no refund is payable.

4. SUBSCRIPTIONS

4.1 If, when booking a parking space, the customer has chosen a subscription (long-term parking), sections 3 – 5 on p. 1 apply.

5. PRICE

5.1. The specified price/monthly fee is in Swedish kronor and includes value added tax.
5.2. Q-Park issues a disclaimer regarding any price/fee errors, price/fee changes, printing and updating errors.
5.3. Q-Park issues a disclaimer in the event that an e-mail may fail to include prices/fees or contain typographical errors, inaccurate descriptions or sold-out products.

6. PERSONAL DATA

6.1. The data provided by the customer is processed in accordance with the legislation on protection of personal data in force at any given time.
6.2. When booking and paying for a parking space at Q-Park, the customer must give a name, personal identity number/corporate identity number, credit card details, address, telephone number and e-mail address. This data is used internally in Q-Park's logistics system in connection with order processing.
6.3. The information is necessary in order to carry out a booking at Q-Park. The customer can cancel the booking at any time if the customer does not wish to provide the information requested.
6.4. The information received will only be used for processing orders and will not be passed on to third parties. However, payment/credit card details will be forwarded to external payment services to enable payment to be made.
6.5. The customer has a right at all times to inspect the data collected on him or her and is entitled to ask for inaccurate or misleading data to be corrected or deleted.
6.6. Questions concerning the personal data collected may be addressed to Q-Park, see section 7.3.

7. OTHER

7.1 Q-Park may revise the above terms and conditions for parking at any time by updating the terms and conditions of the agreement.
7.2 The said terms and conditions have been specifically agreed between the parties and supersede the general agreement terms and conditions, mutatis mutandis, on p. 1. Otherwise,
p. 1 applies, along with the said terms and conditions, between the parties.
